By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the terms "User", "you" or "your" shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Agreement, you must not accept this Agreement and may not access and use the Website and Services.

About the Platform
DrawShare is a platform for creating, sharing, and discovering digital artwork. Users may upload original drawings and artwork, follow other creators, comment on and like posts, and engage with community features. The Services also include optional premium membership subscriptions and direct messaging between users.
"Content" means any data, information, or material you submit through the Services, including digital artwork, images, audio, text, comments, and messages.
Accounts and membership
You must be at least 13 years of age to use the Website and Services. Users between the ages of 13 and 17 must have verified parental or guardian consent as required by the Children's Online Privacy Protection Act (COPPA). By using the Website and Services, you warrant and represent that you meet these age requirements.
If you create an account, you are responsible for maintaining the security of your account and are fully responsible for all activities that occur under it. You must provide accurate and complete registration information and keep it current. We recommend using a strong, unique password. You must immediately notify us of any unauthorized use of your account or any security breach. Providing false contact information of any kind may result in termination of your account. We may suspend, disable, or delete your account if we determine you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation. If we delete your account for the foregoing reasons, you may not re-register for our Services.

User content
We do not own any Content you submit on the Website. You retain ownership of your Content and are solely responsible for its accuracy, legality, and appropriateness. By submitting Content, you grant DrawShare a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display such Content solely as necessary to operate and promote the Services. This license does not permit use of your Content for unrelated commercial purposes without your explicit consent.
We reserve the right to remove any Content that, in our sole discretion, violates this Agreement or is harmful or objectionable. You may delete your own Content through your account settings. Deleted Content may be retained in our backups for a limited period as described in our Privacy Policy, but will not be publicly accessible.
If you upload AI-generated content, you represent that you have the right to use and share such content, and the same licensing terms apply as for other Content.
Content you upload
You may only upload or post images, audio, or other media that you own the copyright to, or for which you have explicit written authorization from the copyright owner. You are responsible for all content you upload. You may not upload or post any copyrighted material in part or whole without permission from the rights holder.
You may upload content under fair use (for example, for criticism, commentary, or education) if permitted by applicable law, but you are responsible for ensuring your use qualifies. Willful copyright infringement may result in civil and criminal liability under applicable law. See our DMCA Policy for information on copyright infringement reporting.
Communicating with users
The Website provides direct messaging functionality for communicating with other users. When using messaging on the Website, you are prohibited from sending unsolicited advertising or spam, sending abusive, harassing, or hateful content, messaging users who have asked not to be contacted, or sending messages that violate our Anti-Discrimination Policy. Violations may result in warnings, temporary messaging restrictions, or account suspension. If you receive a message that violates these rules, please contact us via the contact form.
Billing and payments
We offer optional premium membership subscriptions billed on a recurring basis via our third-party payment processor, Stripe. By subscribing, you authorize us to charge the applicable subscription fee to your payment method on each renewal date. You may cancel your subscription at any time through Account Settings; your access will remain active until the end of the current billing period. We reserve the right to change pricing at any time with reasonable notice.
If you believe a charge is incorrect, contact us within 30 days via the contact form. Non-tangible purchases such as premium memberships are generally non-refundable once access has been granted, except as required by applicable consumer protection law. If you are an EU resident, you have a 14-day right of withdrawal from digital purchases unless you have expressly consented to immediate delivery and waived this right at checkout.
Third-party services
The Website integrates with third-party services including Stripe (payment processing) and Google Analytics (usage analytics, if enabled). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices, content, or actions of any third-party provider. By using features that rely on these integrations, you consent to your data being shared with these providers as necessary to deliver the service.
Prohibited uses
In addition to the terms set forth in our Acceptable Use Policy, you are prohibited from using the Website and Services: (a) for any unlawful purpose; (b) to upload, share, or distribute content that infringes the intellectual property rights of others; (c) to plagiarize or misrepresent another creator's artwork as your own; (d) to harass, abuse, defame, or discriminate against any user; (e) to upload malicious code or interfere with platform security; (f) to scrape, harvest, or systematically collect user data without authorization; or (g) to upload or distribute pornographic, obscene, or otherwise unlawful content.
If your account is terminated for violating this Agreement, you may appeal within 14 days by contacting us via the contact form.
Intellectual property rights
All trademarks, service marks, logos, and platform software associated with DrawShare are the property of DrawShare or its licensors. This Agreement does not transfer any intellectual property rights to you. If you believe another user's Content infringes your intellectual property, please refer to our DMCA Policy.
Disclaimer of warranty
The Services are provided on an "as is" and "as available" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by applicable law, DrawShare, its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or related to your use of the Services. Our aggregate liability to you shall not exceed the greater of one dollar ($1.00) or the amounts you have paid to DrawShare in the one-month period prior to the event giving rise to the claim.
Indemnification
You agree to indemnify and hold DrawShare and its affiliates, directors, officers, employees, and agents harmless from and against any liabilities, losses, damages, or costs, including reasonable attorneys' fees, arising from any third-party claims related to your Content, your use of the Services, or any violation of this Agreement.
Severability
If any provision of this Agreement is found to be illegal, invalid, or unenforceable, the remaining provisions shall continue in full force and effect.
Dispute resolution
This Agreement shall be governed by the laws of the State of New Hampshire, United States, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in New Hampshire. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. EU residents retain rights to pursue claims in their local courts under applicable law.
Assignment
You may not assign your rights or obligations under this Agreement without our prior written consent. We may freely assign this Agreement in connection with a merger, acquisition, or sale of assets.
Changes and amendments
We reserve the right to modify this Agreement at any time. We will notify users of material changes by updating the date at the bottom of this page and, where appropriate, by email or in-platform notification at least 7 days before changes take effect. Continued use of the Services after changes are posted constitutes your acceptance of the revised Agreement.
Acceptance of these terms
You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Website and Services you agree to be bound by this Agreement. If you do not agree, you are not authorized to access or use the Website and Services.
